Chapter 7 Bankruptcy

Chapter 7 is the quickest and easiest form of individual bankruptcy in which all non-exempt property is surrendered and liquidated. Non-exemption varies from state-to-state and can include Social Security payments, unemployment compensation, and limited values of equity in a home, automobile, household goods and trade tools. Chapter 7 will stay on your credit report for 10 years and certain types of debt may not be discharged such as child support, certain taxes and student loans. Also, a debtor may maintain a right to collateral even after the debt is discharged.

Chapter 13 Bankruptcy

Chapter 13 Bankruptcy is a payment plan set up to consolidate your debt. A Chapter 13 bankruptcy, also called a debt consolidation, involves arranging and agreeing to a repayment plan that the bankruptcy court approves. The repayment plan allows you to catch up on house and car payments in manageable monthly amounts. Chapter 13 puts you in control rather than the mortgage and car lenders and your other creditors. It allows you to pay off your creditors while still holding on to your home and your vehicles.
